9.1 Overview of legal framework
The MELEE project aims to develop a decentralized internet access platform. In a decentralized platform, there are different concepts and legal frameworks than in traditional centralized services. Therefore, it is necessary to establish appropriate legal frameworks.
One characteristic of a decentralized platform is that users can freely participate and form a network. Therefore, it is difficult to operate the platform based on traditional legal frameworks. For example, if the platform owner provides services centrally, legal responsibilities regarding privacy protection and consumer protection arise. On the other hand, in a decentralized platform, there is no platform owner, and it is not yet clear how these legal responsibilities should be imposed.
In addition, since transactions using smart contracts are conducted on a decentralized platform, there are questions about their legitimacy and legal effectiveness. For example, if a transaction conducted with a smart contract violates the content of the contract or the agreement between the parties, what legal responsibilities will arise is a problem.
To solve these issues, it is necessary to establish new legal frameworks. Specifically, laws and regulations related to decentralized platforms need to be established to address issues such as privacy protection and consumer protection. In addition, it is necessary to ensure the safety of transactions by introducing a certification system for the legitimacy and legal effectiveness of smart contracts.
